Are Terrorist Prosecutions Are In Jeopardy?

The Bush Administration is taking a risk when they fail to get a warrant and use that evidence to prosecute individuals. Failure to obtain a warrant could force the court to throw out the evidence against the defendant, ultimately putting the prosecutions in jeopardy. Why did the Bush Administration take the risk? Why did they not obtain the required warrant? What does this mean to Americans?
