Anna Nicole's Smith mum has won an appeal against a court ruling that the former Playboy model should be buried in the Bahamas.The Fourth District Court of Appeal in West Palm Beach granted an emergency petition by her mother, Virgie Arthur, to stop a lawyer from taking her body to the islands where Anna Nicole spent the last few months of her life.Richard Milstein is acting as guardian of Anna Nicole's five-month-old daughter Dannielynn, who has been ruled the legal next-of-kin and has been given custody of her mother's remains.He plans to bury Anna alongside her son Daniel but Virgie wants her to be buried in her native Texas.Anna Nicole's longtime lawyer and companion, Howard K Stern, is listed as Dannielynn's father on her birth certificate but Anna Nicole's former boyfriend Larry Birkhead claims he is the father and he is battling with Virgie for custody.His lawyer Debra Opri said: "All the pending actions have been consolidated under Mr Birkhead's fraud action on the birth certificate and we anticipate DNA testing."© Independent Television News Limited 2007.
