OUR COMMITMENT

blinkx (“blinkx”, “we”, “us”, or “our”) recognizes that our customers, users, visitors and others who use www.blinkx.com, applications, or other websites owned or operated by blinkx (the “blinkx Sites”) (collectively or individually “User”, “you”, or “your”) value their privacy. This privacy policy (this “Privacy Policy”) details important information regarding the use and disclosure of User information collected on the blinkx Sites.

The Privacy Policy only addresses our activities from our servers. Other websites, including those that we link to and third-party websites or services that we co-brand, may have their own policies, which we do not control, and thus are not addressed by this policy.

INFORMATION WE COLLECT AND HOW IT’S USED

IP Address

An Internet Protocol address (“IP address”) is automatically assigned to your computer every time you establish a connection to the Internet. The blinkx Sites recognize your IP address. Also, we track the Internet address of the domains from which you arrive to the blinkx Sites, and we use this data for statistical analysis.

Cookies

A cookie is a small text file containing a string of alphanumeric characters that stores data on a User’s hard drive. A cookie cannot access a User’s hard drive, and only contains as much information as the User has disclosed to a particular website. We use both “session cookies” and “persistent cookies”. A “session cookie” is temporary and disappears after you close your browser. A “persistent cookie” remains after you close your browser and may be used by your browser on subsequent visits to a site. When you visit the blinkx Sites we may set one or more cookies on your computer that uniquely identify your browser and collect non-personally identifiable information (“non-PII”) and in some cases personally identifiable information (“PII”) about your activity on the blinkx Sites. We may track general information about each User’s activity on the blinkx Sites such as how many searches you perform and what types of videos you prefer to watch on the blinkx Sites. Unless you are signed in to your blinkx Account (as defined below), we do not track or record specific information about what you search for on our Site. We do not link the information we store in cookies to any personally identifiable information we collect or you submit on the blinkx Sites.

We may store this information after the date of collection for various purposes, including, but not limited to: improving and iterating our technologies; understanding how you interact with the blinkx Sites and the services we offer; customizing and improving your experience; and monitoring User activity on the blinkx Sites in the aggregate. Our AdHoc contextual and behavioral advertising platform (“blinkx AdHoc”) analyzes your activity on the blinkx Sites to show you ads which are tailored to your interests. We may set a cookie or other telecommunications technologies to collect data about your video consumption patterns on the blinkx Sites. Based on this information, blinkx associates your browser with relevant interest categories. We use these categories to show you interest-based ads on the videos you watch on the blinkx Sites.

Opting Out

If you prefer not to receive this type of interest-based advertising, you can opt out of blinkx AdHoc. After you opt out, you will not receive interest-based ads. You will see the same quantity of ads as before, but they will likely not be as relevant to you. To opt out, click the box on this page. When you get a new computer, install a new browser or upgrade certain browsers, erase or otherwise alter your browser’s cookie file, you might end up deleting the cookies in your browser, including the opt-out cookie. If you wish to opt out again, you will need to return to this page and disable the tracking.

Third-Party Cookies

We partner with third-party ad networks and allow such networks to set cookies to collect non-PII for the purpose of serving targeted ads. Such ad networks may use information about your activity on the blinkx Sites to show advertisements about goods and services of interest to you. blinkx has no control over these ad networks or their use of the information they collect. To opt out of third-party behavioral targeting, visit the Network Advertising Initiative’s consumer page atwww.networkadvertising.org/managing/opt_out.asp. After opting out of a network, you will still receive online advertising, but the ads will no longer be tailored to your usage patterns.

Removal of Cookies

To remove persistent cookies, follow the directions in your web browser’s “Help” section. You can configure your browser preferences to refuse all cookies or to indicate when a cookie is being sent, which will give you the choice whether to accept it or not. Please be advised that some features of the blinkx Sites may not function properly if you disable your browser’s ability to accept cookies.

Your browser’s cookie settings may be sufficient indication of your consent to placement of and access to cookies on your computer by blinkx, and blinkx’s collection, use, and disclosure of non-PII and in some cases, PII about your activity on the blinkx Sites.

Policies of Other Sites and Services

The blinkx Sites contain links to third-party websites and online services. If you choose to visit another website or online service by clicking on a link, you will be directed to such third party’s website or online service. The fact that we may link to a website or online service is not an endorsement, authorization, or representation of our affiliation with that third party, nor is it an endorsement of their privacy policies. blinkx has no control over, nor does it bear any responsibility for the privacy policies and/or content of these third-party sites and services. Such third-party sites and services may follow different rules regarding the collection, use, and disclosure of personally and non-personally identifiable information about you, and may place cookies or other files on your computer to collect data from you. blinkx also takes no responsibility for the cookies these third-party sites or services might place on your hard drive. We encourage you to read the privacy policies of other websites and online services before using or providing any information to such website or services.

Sponsored Results

blinkx shows sponsored results where relevant to your query. Sponsored results may contain affiliate marketing links. When you click on a sponsored result, blinkx may be compensated by a third party. By clicking on a sponsored link, you will be directed to a third-party website or service.

Your blinkx Account

You can create an account on blinkx.com (“blinkx Account”) by signing in with Facebook or Twitter, or potentially other platforms. By connecting your Facebook, Twitter, and YouTube accounts (each a “Connected Account”) you can pull all of your favorite videos from across the Web into one place, your personalized “Stream”.

When using the blinkx Sites while signed in, we will automatically receive information about your usage of the Sites, including, but not limited to information such as queries that you make, videos that you watch, dates and times of your requests, your IP address, performance of your network and computer, your operating system, your browser type, language, and other identifying information. When you are signed in, the blinkx Sites log your viewing history. You must be signed out of your blinkx Account to watch anonymously. To learn how to access and edit your “History”, follow the directions on our “Help” page. When you are signed in, you can favorite individual videos and channels by clicking the star icon, which adds the video or channel to your “Favorites”. Only you can see your Favorites. To learn more about your Favorites, including how to edit them, follow the directions on the “Help” page.

When creating a blinkx Account with your Facebook login credentials, or connecting your already existing blinkx Account with your Facebook account, we will also receive, access, and store the following information from Facebook, Inc. (“Facebook”), including, but not limited to: basic information such as your name, username, unique Facebook identifier and access token, profile picture, gender, networks, birthday, location, and website, as well as your News Feed, Status Updates, Activity, Likes, and Friends List.

If you connect your blinkx Account to Facebook, we will make available and/or share your Facebook username and profile picture. Please familiarize yourself with the “Help” page, as it provides you with directions about how to adjust the information in your blinkx Account that may be viewed and your activities that may be shared.

When you connect your blinkx account with your Twitter account, we will receive and store the following information from Twitter, Inc. (“Twitter”), including, but not limited to: basic information such as your username, following list, followers, Tweets, and Twitter stream.

Once your blinkx Account is connected to your Facebook and/or Twitter account(s), your Favorites will be published to these services only if you choose to have them published. If you share your Favorites to Facebook and/or Twitter, your Favorites will be viewable by everyone who is allowed to view your Facebook Timeline and/or Twitter Feed.

When connecting your blinkx Account with your YouTube account, we will receive and store the following information from YouTube, Inc. (“YouTube”), including, but not limited to: subscriptions and viewing history.

You can revoke authorization from Facebook or Twitter from your Settings. For instructions about how to disconnect your blinkx Account from Facebook, Twitter, or YouTube, visit the “Help” page.

Modifying Your Personal Information

If you create a blinkx Account, the personal information which we have about you is obtained directly from your Facebook or Twitter account. To correct, modify, or delete this data, please visit your respective accounts on Facebook or Twitter.

You can view, edit, and delete information associated with your blinkx Account, such as the interest categories that you select to populate your Stream, your Favorites, and your History. To learn more, visit the “Help” page.

You can disconnect your Connected Accounts at any time. You can also deactivate your blinkx Account. When your account is deactivated, any personalized features are no longer available.

Disclosure of Your Information

The name and contact information of persons who request information about blinkx, our subsidiaries, our products and/or services are added to our database so that we may contact them about blinkx’s products, services, or future opportunities.

We use industry-standard efforts, such as firewalls and secure socket layers where appropriate, to safeguard the confidentiality of your information. blinkx is a member of the UK Internet Advertising Bureau (“IAB”) and supports the Good Practice Principles for Online Behavioural Advertising (the “OBA Principles”). Because no method of transmitting or storing electronic data is completely secure, we cannot guarantee that information, including without limitation User data or PII, will never be accessed, used, or released in a manner inconsistent with this policy.

LEGAL ISSUES

blinkx discloses personal information when required by law or in the good faith belief that such action is necessary to conform to the edict of the law or comply with a legal process served on the blinkx Sites; to protect and defend the property rights of blinkx, the blinkx Sites, or our partners; or to act on exigent circumstances to protect the personal safety of blinkx Users, employees, or the general public.

Minors

The blinkx Sites are not intended for children under 18 years of age. We do not knowingly collect personal information about nor do we knowingly advertise to children under 13. If you are under the age of 18, please do not use the blinkx Sites.

Your Consent

By using the blinkx Sites, you consent to the collection, aggregation, use, disclosure, and dissemination of certain non-personally identifiable information and personally identifiable information about you as outlined in this policy.

Your Acceptance

You acknowledge that acceptance of this Privacy Policy, as updated from time to time at this location, is a condition of your continued use of our website and you agree to be bound by all of its terms and conditions.

Notification of Changes

We reserve the right to revise the Privacy Policy at any time. We may update the Privacy Policy from time to time, so please review it frequently; the most current version will govern our use of your information. If we make a change to the Privacy Policy that, in our sole discretion, is material, we will update and post notice of those changes here and other places we deem appropriate such as on our homepage. By continuing to use the blinkx Sites after those changes become effective, you agree to be bound by the updated Privacy Policy.
